The Planning and Development Act 2005 (PD Act) and related legislation commenced operation on 9 April 2006. This legislation consolidated and repealed the Town Planning and Development Act 1928, the Metropolitan Region Scheme Act 1959 and the Western Australian Planning Commission Act 1985.
The WAPC has previously issued two planning bulletins concerning the PD Act and related legislation.
Planning Bulletin 76 Planning and Development Act 2005 and Related Legislation was published in January 2006. It provides an overview of the PD Act and explains the effect of the new provisions on the planning framework.
Planning Bulletin 78 Planning and Development Act 2005 – Summary of amendments and comparison with repealed Acts was published in May 2006. It provides a detailed list of the new provisions in the PD Act and includes a comparative table documenting which provisions were carried over from the repealed legislation.

Draft discussion paper on Road Access Regulations

Section 150 of the Planning and Development Act 2005 regarding control of road access shall not take effect until supporting regulations have been prepared. A draft discussion paper has been released for public comment. The paper identifies the main issues with existing mechanisms used to control road access and explains the statutory covenant mechanism. It also proposes draft drafting instructions.

Part 13, Division 3 of the Planning and Development Act 2005 requires regulations to be prepared to prescribe a regime of planning infringement notices. A draft discussion paper has been released for public comment. While the policy position undergirding each of the provisions yet to come into effect was largely settled with the passage of the PD Act, the paper addresses a number of policy issues on which comment is sought.
