Planning Bulletin 42 Approval Requirements for Public Works Under the Metropolitan Region Scheme (MRS)

This Planning Bulletin outlines the procedures to be followed by public agencies in carrying out development of land under the Metropolitan Region Scheme (MRS).

The procedure has recently been revised following the decision of the Full Court of the Supreme Court in the matter of City of Bayswater v Minister for Family and Children’s Services [2000] WASCA 151. The effect of the Full Court decision is that approval to commence development under the MRS is required for public works by The Crown (State agencies) in respect of land both zoned and reserved under the MRS.
